“Most people hear ‘robot’ and picture something driving around loose on the floor. A lot of ASRS hardware doesn’t work that way. It’s confined to a rail or a grid the whole time, and that distinction is exactly what this rule is built around,” says Bob Jones, Senior Consultant at ISD.

Cube-based grid systems sit in the grayest zone of all: they’re not on a traditional linear rail, but they’re not free-roaming either.
“We’re not telling clients this is settled law. We’re telling them it’s a reasonable reading worth raising with counsel and with vendors, especially before locking into a foreign-produced platform based on fear alone,” says Jones.

Floor-roaming, AMR-based ASRS is the clearest case for coverage. These systems, the Kiva-style robots that drive under a shelving pod, lift it, and carry it across open warehouse floor to a picking station, check every box in the FCC’s four-prong test. They move on the ground, operate away from a human, typically weigh well over 4.4 lbs., and run on networked sensors and control software.
